제주지방국토관리청 사무의 지방정부 이관에 따른 효과분석

Abstract

제주특별자치도 설치 및 국제자유도시 조성을 위한 특별법이 2006년 2월 21일 법률 제7849호로 제정되면서 2006년 7월 1일부로 제주특별자치도가 시행되었다. 이 법을 근거로 제주특별자치도는 국방, 외교, 사법을 제외한 전 분야에서 고도의 자치권을 행사할 수 있게 되었고, 특별지방행정기관인 국토관리 사무, 중소기업 사무, 해양수산 사무, 보훈 사무, 환경 사무, 노동 사무, 제주지방노동위원회 사무 등 7개의 국가 사무가 제주특별자치도 지방정부로 이관되었다. 본 연구에서는 제주특별자치도가 시행되면서 이관된 국가 사무 중 특별지방행정기관인 제주지방국토관리청 사무 중 제주도내 5개 노선의 국도가 지방도로 이관됨으로써 효율적인 도로 유지 관리 사무가 이루어지고 있는지에 대한 효과를 분석하고자 했다. 본 연구를 위해서 제주특별자치도 시행으로 기존의 제주도내 국도가 지방도로 전환되고 국도의 관리 주체가 국토해양부장관에서 제주특별자치도지사로 바뀜에 따라 도로 유지 관리의 문제점이 나타나고 있는지 여부를 크게 세가지 측면에서 분석했다. 첫째, 도로 관리 요소인 제주특별자치도 도로관리사업소의 예산과 인력의 변동에 대해 분석했다. 둘째, 국도의 지방도 전환으로 인한 효율적인 도로 서비스 제공의 여부, 제주도민의 재정적 부담의 가중 여부, 향후 제주도내 도로의 원활한 유지 관리 여부를 지역 언론의 기사, 기고, 사설의 내용을 통한 여론을 분석했다. 셋째, 제주특별자치도 출범 전후 제주 지역 교통사고 발생 현황을 통한 도로 안전성 확보 측면에 대해 분석하였다. 도로 유지 관리의 요소인 예산과 인력의 변동에 대해 분석한 바 제주특별자치도 시행 전후의 도로 유지 관리 분야의 예산이 감소되고 있는 것으로 분석되었다. 향후 도로 이용률의 증가 및 도로의 수명으로 인한 유지 보수 비용의 증가로 제주특별자치도의 재정적 부담이 클 것으로 분석되었다. 또한 도로 관리 분야의 인력도 문제가 있는 것으로 나타났다. 제주특별자치도 도로관리사업소에서 도내 구국도 및 기존 지방도 등의 노선에 대한 도로 유지 관리 사무를 수행하게 되어 도로 관리의 공간적 범위가 확대되었음에도 도로관리사업소의 공무원 정원 및 현원이 감소하였고, 반면 비정규직 인력이 증가한 것으로 나타났다. 이것은 도로 관리의 전문성과 도로 안전성의 확보에 어려움이 따를 것으로 예상된다. 국도의 지방도 전환과 관리 주체의 변화에 따른 지역 언론을 통한 여론 분석에 있어서도 지방 재정 부담의 가중, 중앙 정부의 장기 국도건설계획에서 제주 도 제외, 사회간접자본시설의 확충에 있어서 지방정부의 부담 가중, 중앙정부와의 연결고리의 단절로 예산 및 국비 지원에 어려움이 따를 것이라는 우려의 시각이 나타나고 있는 것으로 분석되었다. 도로의 안전성 확보 측면에서도 위험 요인이 나타나고 있는 것으로 분석되었다. 전국적으로는 교통사고 발생 건수나 사망자 및 부상자의 수가 지속적으로 감소하는 추세를 보이고 있으나, 제주도내 교통사고 발생 건수나 인명 피해 실태는 증감 현상이 반복되고 있고, 최근 교통사고 사망자의 수가 지속적으로 증가하고 있어 도로의 안전성 확보에 부정적 결과로 나타나고 있는 것으로 분석되었다. 이러한 문제를 해결하기 위한 정책적 제언으로써 첫째, 도로법 개정을 통한 제주도내 구국도의 국도 재환원과 국도 건설 및 유지 관리의 국가 사무를 제주특별자치도지사에게 위탁하여 국가 예산을 통한 원활한 도로 유지 관리와 특별자치도로서의 기본 취지를 크게 벗어나지 않는 방안을 제언하고, 둘째, 제주특별자치도 본청과 도로관리사업소로 분산된 구국도를 포함한 지방도 관리 조직을 통합하여 도로 건설 및 관리 분야를 일원화하고, 도로 관리의 예산과 인력을 집중함으로써 도로 관리의 전문성과 행정의 능률성 확보를 제언한다. 셋째, 제주도내 위험 도로의 안전진단 과정을 통해 위험 요소를 찾아내고 개선함으로써 세계자연유산, 국제자유도시, 국제안전도시로의 면모를 갖추기 위한 도로 안전 인프라 구축을 제언한다.

Jeju was designated as a Special Self Governing Province on July 1st 2006 making it possible to exercise its own government policy excluding the nation defence, diplomacy and jurisdiction. As such, 7 special regional administrative departments within Jeju was transferred under the Jeju Special Self Governing Province. With the execution of the Special Jeju Self Governing Province, the current national roads of Jeju has been changed into regional ones and the managing body has been changed from the Ministry of Land, Transport and Maritime Affairs to the administration of the Governor of the Jeju Special Self Governing Province. Following such measures, this study looks and analyzes mainly three factors at whether there are any problems in managing these roads largely in terms of budget, personnel distribution, regional public opinion, and road safety. Firstly, it appeared that there has been a reduction in personnel and budget after the execution of the Jeju Special Self Governing Province in terms of the road management. It could be predicted that there will be an increase in the road usage and the question of how long the roads will last followed by increase in costs in terms of maintaining them in the near future. As per the reduction in the number of professional personnel in the road management department, it has been analyzed that there will be problems ahead in terms of securing the road safety factor. Secondly, in terms of the public opinion through the regional media after the change in the managing body of the national roads, it has been concluded that more burden will be placed on the regional development. Problems such as exclusion of Jeju by the central government's placing of funds in developing future national roads, difficulty in securing social indirect funding facilities, difficulty in budget and national aid due to the severing of connection with the central government were all foreseen leading to considerable concerns and worries. Thirdly, in terms of securing road safety, it has been analyzed that there will be a creation of dangers. On a national scale, the number of traffic accidents or human casualties have been continuously declining, but Jeju has recently shown that it is increasing in the numbers of traffic accidents and human casualties. This phenomenon appears to be repeating itself while the number of death tolls in the traffic accident is becoming serious. It was concluded that not having the securement of road safety had a dire effect on the numbers. To suggest some policy measures against these problems, first, it is the opinion of this author that the management of the Jeju roads be returned to the central government through a reform in the road laws, while the establishment of the national roads and maintaining them be entrusted to the governor of the Jeju Special Self Governing Province. Second, the integration of the managing body which had been separated due to the designation of the Jeju Special Self Governing Province and redistribution of the personnel is advised. Thirdly, seek out the dangers through a safety diagnosis process of the dangerous roads within Jeju and come up with measures to establish a safer infrastructure of these said roads.
