제주특별자치도 행정 계층 간 기능 재배분 정책에 대한 평가 연구

Abstract

2007년 7월1일 기존 지방자치와는 차별화를 둔 제주특별자치도가 출범하였다. 이 는 과거 지방자치의 지역성 및 자율성에서 중앙과 지방간 권한 불평등으로 중앙정 부에 의해 제약을 받는 무늬만 지방자치가 아닌, 형식과 내용이 완전 결합된 다양 성이 존중되며 분권이 제대로 이뤄지는 것을 말하는 것이다. 이것은 중앙정부가 제주특별자치도에만 주는 것이 아니라 단일광역체제인 제주특 별자치도가 행정시 및 읍·면·동의 다양성을 존중하며 형평성 있는 권력 재분배를 통해 앞서나가는 민주적인 제주도만의 제주특별자치도가 되는 것이다. 그래서 제주특별자치도는 계층간의 기능 재배분을 통해 제주특별자치도의 권한이 도 본청으로 집중되는 현상 등으로 인해 행정 민주화 및 주민자치의 문제점을 보완 등으로 이해 읍․면․동 기능강화 정책이 시행되었다. 그러나 특별자치도 7년이 지 난 지금 읍·면·동은 밀착 행정을 위한 위임업무만 늘어났을 뿐 인력 보강이나 기능 강화를 위한 재원이나 권한이 주어지지 않았으며, 반면에 도로 모든 권력이 집중화 된 사실이 여러 면에서 드러나고 있다. 이는 제주특별자치도가 갖는 이념과 철학인 고도의 분권화와 다양성 존중과는 반하는 것으로 단일 광역의 단일체제라는 곳에 권력이 집중 되어 한 곳으로만 집중되는 현상으로 인해 읍·면·동이나 행정시의 다 양성 존중 및 권력 재분배에 관심을 두지 않는 것으로 보인다. 이에 본 연구는 7년 여가 경과한 현재 제주특별자치도 행정계층간 기능 재배분정책 평가를 권력의 양면 성 관점에서 살펴보는데 목적이 있다. 본 연구는 행정계층간 기능 재배분정책 평가 연구로써 제투특별자치도 읍·면·동 기 능 강화 정책을 사례로 선정하였으며, 문헌연구 및 각 종 통계를 토대로 하여 인력 및 예산 부문으로 나누어 살펴보았다. 이번 연구결과를 통해 제주특별자치도 이후 시행된 읍․면․동 기능강화 정책은 제 대로 작동되지 않았으며 권력의 재배분의 문제점은 권력의 양면성에 기인하는 것으 로 보인다. 이를 살펴보면 권력의 한 면에서는 정책 문제를 해결하기 위해 정책 결정에서 영향력 행사가 인력 및 예산정책 결정에서 권한자인 도 본청에 유리한 방향 으로 추진하면서 읍․면․동 기능 강화에는 무심한 경향을 보이고 있음을 알 수 있 으며, 다른 측면에서는 정책의제설정 과정에서 나타나는 무의사결정으로 읍․면․동 기능 정책 추진 시 표출되는 갈등들이 무의사결정의 추진 수단인 수정 및 보완된 체제 등의 간접적․우회적 방법 나타나는 것을 볼 수 있었다. 본 연구는 과거 제주특별자치도 출범 전후를 통해 발표 된 행정구조개편의 효율성 및 특별자치도 이념과 현실에 주를 이루는 논문과 달리, 제주특별자치도 정책의 문 제점을 계층간의 권력 재배분의 권력의 양면성을 통해 살펴보았다. 그러나 이 연구 는 사례를 읍·면·동 및 인력과 예산이라고 한정하고 있어 논의의 한계를 가지고 있 다.

On July 1st, 2007, Jeju Special Self-governing Province, which was differentiated from the existing provincial government, was established. What this new type of local government implies is that we now have an administrative body where the diversity combining forms and contents is respected and decentralization is properly carried out, rather than a specious local government whose locality and autonomy were constrained by the central government due to the inequality of authority between the central part and other regions. This also means that not only did the central government give Jeju autonomy, but also Jeju as a single regional administrative structure respects municipal administrations as well as eup·myeon·dong while building the democratic island's unique self-governing province by redistributing power fairly. In this regard, Jeju Special Self-governing province initiated the policies to enhance functions of eup·myeon·dong authority of the provincial office by redistributing functions among different administrative bodies, which would prevent the authority from being concentrated on the provincial government, and by fixing problems with both the democratization of adminstration and citizen autonomy. However, seven years has passed and now eup·myeon·dong offices have more tasks entrusted for the close administration without any reinforcements of funds or manpower. Meanwhile, there have been many cases where all the power went back to the provincial office. The phenomenon is against the concept and philosophy of Jeju Special Self-governing Province that purses high level decentralization and respects diversity, so it can be seen that no attention has been paid either to the respect for the community centers and municipal governments or to power redistribution because of the phenomenon where power is usually concentrated into one single administrative agency in one region. Hence, seven years after the inception, this study aims to examine the evaluation of the function redistribution policies among different administrative levels of Jeju Special Self-governing Province from the perspective of the two faces of power. The study, as the evaluation study on the policy of redistributing functions among different administrative levels of Jeju Special Self-governing Province, selected the provincial office's policy implemented in order to strengthen the functions of eup·myeon·dong and divided them into two sections of manpower and budgets based on other related documents and research as well as a number of statistical data. According to the findings of the study, the policies to enhance the functions of eup·myeon·dong that have been implemented since Jeju Special Self-governing Province set forth didn't work as they were intended. Furthermore, the problem with the power redistribution was derived from double-sidedness of power. Looking into the power structure closely, on one side of it, the provincial government, as the one with authority, takes the advantageous position in exercising power when making decisions on manpower and budgets to solve the problems with the policies while neglecting the enhancement of the functions of eup·myeon·dong. On the other side of power, when promoting the functions of eup·myeon·dong through non-decision making emerging in the process of selecting agendas for the polices, conflicts arise and they are expressed in indirect-periphrastic ways such as correcting and complementing measures, all of which are ways to carry forward non-decision making. Unlike the previous theses that focused on the reality as well as the ideology of the provincial government and the effectiveness of the reorganization of administrative structures announced before and after Jeju Special Self-governing Province was established, this study investigated the problems with the polices of power redistribution among different levels through the perspective of two faces of power. However, the study has a limit in discussion since it restricts the subjects to eup·myeon·dong and manpower and budgets
