건설공사 안점점검대가의 적정성에 대한 고찰

Abstract

건설 산업에서의 안전점검은 건설공사 시 사고예방 뿐만 아니라 건설업의 재 해율을 감소시키기 위한 매우 주요한 활동이며, 전체적인 안전관리 업무의 효율 성 제고를 위하여 기본이 되는 활동이다. 안전점검과 관련된 규정 중 건설기술진 흥법 및 시설물 안전관리에 관한 특별법에서는 건설공사 시 안전에 관한 내용의 기술과 동시에 유지관리 측면에서의 안전점검의 관한 사항을 규정하여 건설 산 업에서의 사고예방을 담당하고 있다. 그러나, 공공기관 발주시설물과 민간발주시설물의 관리 정도의 편차가 심하며 특히 개인공사 발주형태의 건설공사인 경우에는 형식적인 점검과 유지관리가 지 속되고 있는 게 현실이다. 실질적인 근로자 안전 확보의 일임을 담당하고 있는 규정 중 고용노동부의 안 전점검과 관련된 규정은 유일하게「산업안전보건법 제32조 재해예방전문지도기 관의 지도기준」과「건설업산업안전보건관리비 계상 및 사용기준」에 의거하여 건설공사 착공 시 관련기관과의 계약과 동시에 준공 시까지 안전점검을 받도록 하고 있다. 하지만, 이 역시 발주기관에 따라 관리정도의 편차가 심하여 소규모 민간 발주 공사현장은 점검이 형식적으로 이루어지고 있으며, 세부규정도 없이 계약만 유지되고 있어 점검대가는 지속적으로 하락하고 있는 실정이다. 본 연구에서는 제주지역에서 실질적으로 이루어지고 있는 안전점검의 형태를 3년간 조사하여 공사금액별로 구분․비교하면서, 적정한 대가를 각각의 건설관련 법에 근거하여 산출해 보았고 나아가 세부 규정에 관한 개선방안을 제시하였다.

Safety checks in the construction industry make a very important activity to prevent safety accidents during construction and reduce the hazard rate of construction industry and a basic activity to improve the efficiency of overall safety management work. Of safety check regulations, the Act on the Promotion of Construction Technologies and the Special Act on the Safety Control of Public Structures contain provisions about the content of safety in construction works and the items of safety checks in the maintenance aspect and thus contribute to accident prevention in the construction industry. There is, however, a huge gap in the degree of management between the facilities ordered by public agencies and those ordered by the private sector. Formal inspection and maintenance continue on in personal construction works. Of the regulations responsible for the practical safety of workers, the safety check regulations of Ministry of Employment and Labor demand for safety checks from the start of construction based on an agreement with a concerned agency to the completion of construction solely based on "Guidance Standards for the Specialized Disaster Prevention Instructions in Article 32 of Industrial Safety and Health Act" and "Appropriation and Usage Standards of Safety and Health Management Costs in the Construction Industry." There is, however, a huge gap, as well, in them according to client agencies. In small construction sites ordered by a private organization, checks are done formally with no detailed regulations. As a result, the costs of checks continue to drop with only the contract kept intact. This study examined the forms of safety checks practically done in the Jeju region for three years, distinguished and compared them by the construction costs, calculated proper costs based on each construction act, and further proposed improvement measures for the detailed regulations.
