제주특별자치도 통합형 교육위원회에 대한 연구

Abstract

본 연구는 2010년 개정된 「지방교육자치에 관한 법률」에 의하여 전국적으로 시·도의 상임위원회로 이행하기에 앞서 제주특별자치도의 출범과 더불어 실험모델로 운영되고 있는 교육위원회 제도에 대한 검토를 통하여 법·제도 개선의 방향을 탐색하기 위하여 시도하였다. 이 연구를 수행하기 위하여 첫째, 「지방교육자치에 관한 법률」의 개정 전후 및 「제주특별법」에 나타난 교육위원회 관련 조문을 비교 정리하였고 둘째, 출범 이래 2007년 12월말까지의 활동 상황을 정리하여 종전의 교육위원회 활동과 비교 분석하였다. 셋째, 현 교육위원회의 제도상의 문제점을 도출해내기 위하여 지방의회, 지방의원, 교육감, 의회 사무처 등 주변 환경과의 관계에서 드러나는 제반 사항들을 정리하였고, 넷째, 가장 쟁점이 되는 사항들에 대하여 법과 조례상의 상치되는 점과 실제 운영상에 도출된 문제점으로 분리하여 분석하였으며, 이와 관련하여 교육위원회가 제시하고 있는 조례 개정 사항과 교육위원회 소속 의원들과의 면담을 통하여 직접적으로 인지하고 있는 문제점들을 재정리하였다. 그리고 위에서 정리한 내용을 중심으로 제도 변화에 따른 쟁점 사항과 개선방안을 법·제도적인 측면과 실제 운영의 측면으로 나누었다. 먼저 법·제도적인 측면으로는 교육의원 후보자격과 관련한 엄격한 이중 요건 적용으로 인한 주민 대표성의 논란, 교육의원의 정당과의 관계에서 오는 정치적 중립성의 문제, 독자적인 발의 요건, 의장 피선거권과 교섭단체권의 문제, 선출방식의 문제, 교육경력의 다양화 논의, 현직 교사의 진출 허용의 문제를 다루었다. 다음 실제 운영의 측면으로는 교육의원의 위상 정립 강화 방안, 역할 정체성의 문제, 교육위원회 전문위원실 조직의 문제, 지방의회 내의 의사소통의 문제를 지적하였고, 끝으로 앞서 논의되는 점들은 현 교육의원의 임기 중에 중에 정리해야 할 책무라는 점에서 몇 가지 제언으로 마무리하였다.

The purpose of the study is to analyze and review the integrated school board model which has been experimented in Jeju before it is operated nationwide in 2010 based on 지방교육자치에 관한 법률, and suggest new ways for reform the model. For the purpose of the study, the researcher compared new and former sections in 지방교육자치에 관한 법률, and activities of new school board and former school board. Also, the researcher gathered data on interactions between the school board ant the local assembly, other assembly men, secretariat of assembly. The results of the study suggest that it is need to make provisions for political neutrality of school board members because of lack of clear prescriptions on laws. Second, it is needed to mitigate requirements for proposals to make school board members propose their opinions independently and rearrange jurisdictions of school board to achieve intentions of the integrated school board. Third, it is need not to specify the number of school board members to change the current situation in which school board members are excluded to be a chairman of the local assembly. Fourth, there should be changes in the law and regulations to make school board members exercise the right of collective bargaining. Also, the election district should be made some measures because school board members' election district is wider than that of other local assembly members. Finally, to accomplish the intention of layman control, the requirement for teaching-related experiences should be lessened. Also, to take rank with social change and other occupations, younger generation can make an entry of the board rather than retired principals or retired high ranked district administrators.
