A Study on the Civil Liability for the Accidents of Autonomous Vehicle
Abstract
현대사회가 4차 산업혁명으로 발전함에 따라 종래 인간의 신체활동 영역이었던 부분들이 인공지능(AI)기술이 적용된 제품들에 의해 대체될 것으로 예상된다. 그 중에서도 우리의 실생활과 가장 밀접하게 관련되는 것은 자율주행자동차를 들 수 있다. 현재 자율주행기술 전반에 대한 안전성은 검증되지 않았으며 자율주행자동차는 기술개발 단계에 머무르고 있어 자율주행자동차의 실운행을 위한 많은 개선이 필요하다. 특히 자율주행시스템의 오류로 인한 교통사고 발생가능성이 존재하는바, 현행 법령에서는 자율주행자동차사고와 관련한 손해배상책임을 명확하게 규정하지 않은 문제점이 있다. 따라서 자율주행자동차가 상용화된 이후에 발생하게 될 사고에 대한 법적책임을 어떻게 규율할 것인지에 대한 구체적인 검토가 필요하다.
자율주행자동차사고는 시스템이 인간의 운전행위를 대체하였다는 점에서 운전자의 부주의보다는 시스템의 결함에 의해 발생할 가능성이 높다. 따라서 인간의 과실을 중심으로 논의해 왔던 기존의 민사책임구조와 달리 시스템의 오류 등 자율주행자동차의 결함으로 인해 발생하는 사고의 경우 누가 최종적인 손해배상책임을 부담하는지, 그 책임의 근거는 무엇인지에 대한 판단이 필요하며 이를 위해 자율주행기술의 단계구분을 중심으로 민사책임구조의 변화와 이를 반영한 합리적인 규율방안과 입법론을 제시하고자 한다.
자율주행자동차는 인간이 아닌 시스템에 의해 운행된다는 점에서 인간의 행위를 중심으로 손해배상책임을 논의하던 일반 자동차사고와 차이점이 있다. 예컨대 자율주행자동차 사고로 인한 손해배상책임은 자율주행기술과 관련한 운전자와 시스템간의 제어권 배분 및 책임의 분담으로 정해지는데, SAE는 자동차의 운행에 있어 운전자와 자율주행시스템 사이에 자동차에 대한 제어권을 누가 행사하는지에 대한 역할배분을 중심으로 총 6단계로 자율주행기술을 구분하고 있다. 이러한 SAE의 자율주행기술 단계구분에 따르면 레벨0-레벨2는 기존의 교통사고에 대한 책임구조가 적용되나 레벨3 이상의 단계에서는 자율주행기술의 특질에 따라 운전자개념과 운전자의 주의의무 등에 변화가 있게 된다. 레벨3의 경우 수시로 자동차에 대한 제어권이 자율주행시스템과 운전자로 변동될 수 있다는 점에서 제어권 전환(take-over)을 대비할 의무가 있다. 레벨4의 경우 자율주행 중에는 운전자가 개입할 여지가 없으며, 운행가능영역을 벗어난 경우에만 운전자가 운전행위를 수행할 의무가 있다. 레벨5의 경우 차량에 탑승한 자는 모두 승객이 되고 승객은 목적지를 설정하는 외의 행위를 할 필요가 없게 된다. 이러한 자율주행기술 단계구분에 의해 사고발생시 차량에 대한 제어권을 누가 보유하였는지 판단하고 이를 기준으로 책임귀속을 검토하게 된다.
자율주행자동차사고에 대한 민사책임을 합리적으로 규율하기 위해서는 자율주행기술을 중심으로 단계구분 및 그에 따른 책임귀속을 구조적으로 판단하여야 하며 이를 위해 자율주행자동차에 대한 안전기준을 설정하고 있는 규제법제와 책임법제를 유기적으로 살펴보아야 하는데 국제협약과 미국, 영국, 독일, 일본, 우리나라를 중심으로 자율주행자동차에 대한 각국의 입법례를 정리하고, 우리나라의 입법과정에 도입할 필요가 있는 규정을 중심으로 그 시사점을 확인하였다. 자율주행기술의 특질과 단계구분에 따르면 운전자의 과실책임을 중심으로 한 일반 자동차의 민사책임구조는 수정이 불가피하고 자율주행자동차 기술과 연관된 운전자의 개입정도에 따른 책임분담을 통해 신속한 분쟁해결과 자율주행기술 발전을 저해하지 않는 범위 안에서 균형점을 찾아야 한다. 이를 위해 운전자책임, 운행자책임, 제조물책임을 재구성할 필요가 있다.
이를 세부적으로 살펴보면 첫째, 운전자책임과 관련하여 자율주행기술단계 중 레벨3과 레벨4의 경우 시스템과 운전자 간의 제어권 배분에 따라 운전자의 주의의무가 상세하게 구분된다는 점에서 이를 위반한 경우 부담하게 되는 운전자책임 또한 규제법제에서 규정하여야 한다. 둘째, 운행자책임과 관련하여 자율주행자동차의 경우 레벨3이후 단계에서도 운행자성을 보유하므로 운행자책임이 인정된다는 명시적인 규정을 도입하되, 책임보험가입을 통해 운행자가 승객에 불과한 경우 보험사로부터 손해를 보상받을 수 있도록 하며, 면책규정 중 구조 및 기능적 장해가 증명된 경우에는 운행자책임을 면하도록하여 운전자책임을 완화해야 한다. 셋째, 제조물책임과 관련하여 시스템의 오류로 인한 자율주행자동차사고의 경우 제조사의 제조물책임이 인정될 가능성이 높은데, 인공지능기술인 소프트웨어는 민법이 규정하는 동산에 해당하지 않아 현행 제조물책임법에 의하면 제조물성이 부정된다. 그러나 자율주행자동차의 안전성 확보 측면과 제조물의 결함으로부터 피해자를 보호할 필요를 고려하여 소프트웨어의 제조물성에 대한 근거규정을 명시적으로 도입해야 하며, 제조물책임의 입증책임을 좀 더 완화하고 제조사의 면책사유를 일부 배제하는 방향으로 개정하여 제조물책임을 강화하여야 한다.
이 논문에서는 이상과 같이 자율주행자동차사고에 대한 민사책임을 체계화함에 있어 자율주행기술의 전반적인 개관과 자율주행기술 단계구분의 내용을 세부적으로 살펴보았으며 이를 기준으로 자율주행자동차 사고를 유형화하고, 일반 자동차사고의 민사책임구조와 다른 자율주행자동차사고의 민사책임구조를 재구성하기 위하여 운전자책임과 운행자책임, 제조물책임을 중심으로 검토하였으며, 실질적인 피해구제 및 책임의 적정한 배분을 위하여 운전자책임에 대한 명확한 규정의 도입과 운행자책임의 완화 방안, 제조물책임의 강화 방안을 제시하였다.
With the progress of the fourth industrial revolution, it is expected that human physical activity will be substituted with work done by products where artificial intelligence (AI) technologies are used. Among the products with such technologies, the one most closely related to our daily lives is an autonomous vehicle, which, however, is still in the stage of technical development, while the overall safety of automated driving technologies has not been verified. Accordingly, there still is a possibility of car accident caused by system malfunctions, but the current law does not clearly stipulate liability for damages related to an autonomous vehicle accident. Therefore, it is necessary to make a detailed examination of the way to regulate civil liability for autonomous vehicle accidents after the commercialization of autonomous vehicles.
Considering that an autonomous vehicle is driven by a system, many changes are required regarding an entity subject to liability and the basis and scope of liability for an accident, while liability for damages caused by a general car accident has been discussed focusing on human activity. For example, liability for damages caused by an autonomous vehicle accident brings up issues over distribution of control and division of liability between human and system regarding automated driving technologies, and human involvement is a criterion to determine the subject to liability and the basis of liability at SAE Level 3 and Level 4 of driving automation.
While liability of a driver involved in liability for torts under the Civil Law, liability of an operator under the Guarantee of Automobile Accident Compensation Act and product liability under the Product Liability Act are considered in case of general car accidents, whether human is still a driver of an autonomous vehicle, whether a system assumes liability of a driver, who or what an operator of an automobile is during the operation of a system, whether the developer of software assumes product liability in case of an accident caused by malfunctions of automated driving software, etc. need to be examined in case of autonomous vehicle accidents.
he aspects of automated driving technologies to be discussed in detail in this paper serve as the roles and obligations expected from the passenger of an autonomous vehicle, while the breach of such roles and obligations serves as the basis for the assumption of liability for damages. Therefore, the levels of driving automation serve not only as safety standards for automobile manufacturers but also as factors to be considered to determine the subject, basis and content of liability in making a judgement on civil liability to provide relief to victims.
More specifically, in case of liability of a driver in association with the levels of driving automation, there are differences in a driver's duty of care between levels. A detailed examination needs to be conducted regarding what the content of duty of care assumed by a driver is and whether a driver assumes the same duty of care under the operation of an autonomous driving system at Level 3, and regarding whether human act as a driver at Level 5.
As liability of an operator has been admitted under the principle of liability for risks, there is a debate about whether such liability can still be validly acknowledged in case of an autonomous vehicle accident, with liability of an operator under reduced level of an operator's control over driving being the main issue. In this regard, liability of an operator is still admitted on the basis of creation of risk source regardless of the different levels of driving automation from the viewpoint of those who stick to the principle of liability for risks. However, where control over driving is strictly required, such liability cannot be established if an automobile is operated by a system.
Regarding product liability, where an automobile is operated by an automated driving system, a system malfunction is the main cause of an accident, with human activity being excluded. In this case, the developer of automated driving software needs to assume product liability. In this regard, whether software, the core of an automated driving system, is included in products, to what extent a software defect is acknowledged, who the subject of liability for a software defect is, the existence of a defect and incurrence of damages, etc. need to be examined.
As above, a discussion about civil liability in an autonomous vehicle accident is necessary for the settlement of legal disputes following the commercialization of autonomous vehicles along with the substitution of human-oriented driving by artificial intelligence technologies. Such discussion has importance in that it not only brings prompt relief to victims but also proposes the direction for elimination of uncertainty and guarantee of safety regarding liability expected in case of accidents for manufacturers and regulatory agencies.
Liability of a driver, liability of an operator and product liability need to be reconstructed to reflect the distinct characteristics of autonomous vehicle accidents which involves the distribution of control between a system and human. Besides, clear criteria on the subject and basis of liability need to be proposed considering automated driving technologies.
In this paper, legislation will be proposed to introduce a regulation which reconstructs civil liability discussed in case of a general car accident and clarifies liability of a driver, and to relieve liability of an operator and thus strengthen product liability, in relation to autonomous vehicle accidents. Since the current law does not clearly specify civil liability for an autonomous vehicle accident, the author of this paper hope this research will be reflected to clarify the practical subject and basis of liability in the process of modification laws and regulations regarding civil liability related to autonomous vehicles in the future, and consequently contribute to prompt relief to victims by eliminating uncertainty which hinders the development of autonomous vehicle industry and preventing the exercise of unnecessary rights of indemnity.
