제주지역 외국인 불법 체류자의 발생원인 및 실태조사

Abstract

Since the mid-to-late 1980s, the decline in the working population has accelerated in Korea. The phenomenon of Korean workers avoiding the 3D industry has caused many small and medium-sized enterprises in the 3D sector to suffer from a severe labor shortage. To solve this situation, the mass influx of foreign workers began. As the number of foreign workers in Korea continues to increase, the issue of foreign workers has also begun to draw attention from the Korean government and society. Among them, the problem of illegal stay of foreign workers is serious. According to the Ministry of Justice in Korea, about 2.37 million foreigners stayed in Korea in 2018, and about 360,000 of them were illegal. Jeju Island introduced the No Visa system for the first time in Korea with the launch of an international free city in 2002. For the first six years, only group tourists invited from Jeju Island were allowed, but after the expansion of the visa-free system to individual tourists in 2008, the number of foreign tourists visiting Jeju Island surged. In particular, a manpower market is being formed in Jeju Island to provide convenience to foreigners who enter Jeju Island using the visa-free system for illegal employment and to provide tens of billions of won in illegal residency and job placement. In order to accurately understand the actual situation of illegal foreign residents living in Jeju, 200 questionnaires were distributed to illegal Chinese residents. Based on these findings, the working and living conditions of illegal residents were investigated and analyzed. This paper was compiled and analyzed by searching domestic and international academic books, research reports, and publications of media and government-related institutions related to foreign workers staying in Korea, and the causes of the formation of illegal aliens were economic, institutional and social causes. Based on the results of the survey, this paper proposed measures to solve the problem of illegal foreign residents and to strengthen the development and cooperation of the global economy through the utilization of migrant workers. In addition, the government is proposing tougher crackdowns on illegal employment industries as a way to solve the problem of illegal employment in the short term.

80년대 중후반 이후 한국에서 노동 가능 인구의 감소가 가속화 되고 있다. 한국 국내 노동자들이 3D 업종을 기피하는 현상이 나타나고 이로인하여 3D 업종에 속하는 많은 중소기업들이 심각한 노동력 부족난에 들었다. 이러한 상황을 해결하기 위해 외국인 노동자의 대량 유입시대가 시작되었다. 한국국내 외국인 노동자 수가 계속 증가함에 따라 외국인 노동자 문제도 한국 정부와 사회의 관심을 끌기 시작했다. 그중에 외국인 노동자 불법 체류 문제가 심각하다. 한국 법무부에 따르면 2018년에 한국 국내 체류의 외국인은 약 237만명이며, 이중 불법 체류자가 약 36만명정도 되는 것으로 조사되었다. 제주도는 2002년 국제자유도시 출범과 함께 한국 국내에서 처음으로 무사증(No Visa) 제도가 도입되었다. 처음 6년 동안은 제주도에서 초청한 단체관광객만 허용되었으나, 2008년 개인 관광객에도 무사증제도를 확대 적용한 이후, 제주도를 방문하는 외국인 관광객이 급증하였다. 특히, 불법취업을 목적으로 무사증 제도를 이용해 제주도에 들어온 외국인에게 불법체류 행위에 편의를 제공하고 수백억원의 제주지역 불법체류 및 취업알선을 하는 인력시장이 제주도내에 형성되고 있다. 제주지역에 사는 외국인 불법 체류자들의 실제 상황을 정확한 파악하기 위해 중국인 불법 체류자 대상으로 설문지 200부를 배포하여 조사하였다. 이러한 조사결과를 바탕으로, 불법 체류자들의 근무 및 생활 현황을 조사하고 분석했다. 본 논문은 한국에 체류하는 외국인 노동자와 관련 된 국내외 학술저서, 연구보고, 언론과 정부 관련 기관의 출판물 등 문헌을 검색하여 정리분석하고 불법 체류자 형성의 원인이 경제적의 원인, 제도적 원인과 사회적 원인으로 정리되었다. 본 논문은 설문조사결과를 바탕으로 외국인 불법체류 문제 해결을 위한 방안과 이주노동자의 활용을 통한 세계경제의 발전과 협력을 강화하는 방안을 제시하였다. 더불어 단기적으로 불법체류 문제 해결하기 위한 방안으로 불법 고용 산업에 대한 단속 강화를 제안하고 있다.
